TERMS OF SALES

The following provisions establish the general conditions of sale of products sold by “Bébé Alpin” (defined as the seller) on the site https://bebealpin.com/. These conditions govern the contractual relations between the seller and the buyer.

Any order placed with “Bébé Alpin” tacitly implies complete and unreserved acceptance of the general conditions of sale below.

They apply to all orders placed with the store for the following product categories:

Items in stock
orders for tailor-made items on site, or during exceptional sales off the website.
Any failure on the part of the seller to fulfill one of its obligations, mentioned in these general conditions of sale, can under no circumstances be interpreted by the buyer as a waiver of the general conditions of sale.

These conditions may be subject to change without notice. In this case, the applicable conditions will be those in force on the date and time of the order by the buyer.

The Customer declares to have read all of these General Conditions of Sale and to accept them without restriction or reservation.

The Customer acknowledges that he has received the necessary advice and information to ensure the suitability of the offer to his needs.

The Client declares that he is able to legally contract under French laws or validly represent the natural or legal person for whom he is contracting.

Unless proven otherwise, the information recorded by the Company constitutes proof of all transactions.

ARTICLE 2: IDENTIFICATION OF THE SELLER

The Bébé Alpin company is a micro-enterprise registered with the Chamber of Trade and Commerce of Chambéry not subject to VAT according to article 293B of the general tax code. It sells baby accessories online. Each model is produced or manufactured in small series in so-called “standardized” sizes.

ARTICLE 3: PRODUCTS AND INTELLECTUAL PROPERTY

All creations presented on this site are the property of Bébé Alpin and its creator Anaïs Véronèse. They are protected by copyright and intellectual property. Bébé Alpin is a trademark registered with the INPI, any counterfeiting or reproduction, even partial, is subject to legal action.

Any use or reproduction without authorization of the texts, comments, photos, sewing patterns and articles present on this site are strictly prohibited (art.4.335-3).

ARTICLE 4: CHARACTERISTICS OF PRODUCTS AND ORDERING METHOD

Hand-made items.
These items are made to measure and at the customer's request. There is therefore no photo of the finished product when placing the order.

The textile creations ordered will be entirely handmade. They may therefore present irregularities and variations depending on the materials and customizations chosen by the customer compared to the photos presented on the site.

The seller strives to give as much detail as possible on the items presented, so that the customer can know all the characteristics as best as possible before ordering. The photos and drawings of the articles appearing on the site are non-contractual; we strive to ensure that they are as faithful as possible to the property offered for sale. We draw your attention to the fact that the resolution and calibration of computer screens can cause the color nuances and rendering of materials to vary from one screen to another. The buyer cannot under any circumstances hold the seller responsible.

Products in stock
All the textile creations offered are entirely handmade. They may therefore present irregularities and variations in terms of material, colors, etc. In addition, brightness and materials may be slightly different in the photos from the actual item.

ARTICLE 5: PLACING AN ORDER

Any order will only be validated after payment has been accepted.



Bébé Alpin undertakes to honor orders received according to the deadlines indicated within the limits of available stocks and in the event of unavailability to inform the Customer by any means whatsoever; the Customer may then cancel his order and be reimbursed, if applicable, the sums already paid. Bébé Alpin reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order.

In order to place an order for items sold on the site, the customer is invited to create a customer account by completing the form that will be offered to them at the time of their order. He undertakes to provide sincere and accurate information concerning his marital status and his contact details, in particular his email address and his personal address in the event of choosing home delivery.



Shipping an item in available parts takes approximately 1 week. The order is sent on the Tuesday or Friday following the order.



In the event of non-compliance with the CGV and/or CGU, the seller will have the possibility of suspending or even closing a customer's account. Once the transaction is finalized, the buyer will receive by email the summary of their order as well as an invoice proving the purchase.

ARTICLE 6: THE PRICE

Prices are communicated in euros (EUR €) including tax and are only valid on the day the order is validated by the seller and the buyer.

Payments for orders, items in stock or made to measure, will be made by credit card only, or by bank transfer.

The prices of the items do not include shipping costs which will be charged in addition to the rate indicated when validating the basket. Customs duties or other local taxes or import duties or state taxes may be payable in certain cases. These rights and sums do not fall within the responsibility of the Seller. They will be the responsibility of the buyer and are his responsibility (declarations, payment to the competent authorities, etc.).

The Seller therefore invites the buyer to inquire about these aspects with the corresponding local authorities.

As a micro-entrepreneur, the seller is not subject to VAT. This tax is not applicable, in accordance with article 293B of the CGI

The Company reserves the right to modify its prices at any time for the future.

The telecommunications costs necessary for access to the Company's website are the responsibility of the Client.

ARTICLE 7: PAYMENT METHODS

This is an order with obligation to pay, which means that placing the order involves payment by the buyer. The order will only be validated after receipt of payment of the balance of the invoice.

Payment of the price is made in cash when ordering, whether when purchasing a product in stock, such as a custom order. To pay for his order, the buyer has, at his choice, all the payment methods made available to him by the seller and listed on the seller's website:

By bank card (Carte Bleue, Visa, Eurocard, Mastercard), it being specified that payments are secured by the universal SSL encryption process, associated with the Stripe payment solution.
In this case, the buyer must transmit the number of their bank card on the Site, as well as the expiry date and the cryptogram number (3-digit number appearing on the back of their bank card), it being specified that the data relating to the bank card is only kept during the processing time of the order (secure communication protocol).
The card will be debited at the time of ordering.

The online provision of the bank card number and the final validation of the order will constitute proof of the entirety of the said order.

Wire Transfer. The buyer must contact the seller so that the latter sends them the banking information (RIB) as well as the delivery amount to be paid by the buyer. The order or purchase of a product will only be validated when the bank transfer is accepted.
By species, are only accepted in the event of withdrawal of order by the buyer.
The buyer guarantees to the seller that he has the authorizations possibly necessary to use the payment method chosen by him, when validating the order form. The seller reserves the right to suspend all order management and delivery in the event of refusal of authorization for payment by credit card from officially accredited organizations or in the event of non-payment. The seller reserves the right in particular to refuse to make a delivery or to honor an order from a buyer who has not fully or partially paid a previous order or with whom a payment dispute is being administered. .

ARTICLE 8: DELIVERY TIMES AND SHIPPING COSTS

Items in stock are shipped within 2 to 7 working days after receipt of payment. This deadline can be extended up to 7 days in the event of special periods such as sales and holiday periods (end of year celebrations, Mother's Day, Father's Day and private sales).


Orders placed during business closures will be shipped on a delayed basis.



The delivery methods offered are as follows:

Sending to collection point via Mondial Relay
Collection by appointment only.


The delivery method is at the buyer's choice and also depends on the format of the item shipped. (example: objects over 3 cm thick cannot be sent by registered letter). At the time of shipment, your invoice and tracking number will be communicated to you by Email (or generated by the site).

Shipping rates vary depending on the country.

The seller will not be held responsible for any events taking place once the order has been shipped (extended delivery times linked to the carrier, loss of goods, strike, bad weather, non-receipt of order, package returned by the relay point, etc.).

In the event of an incident occurring during transport, the customer must then make a complaint directly to the carrier they chose when placing their order.

The products are delivered to the address indicated by the buyer on the order form, the buyer must ensure its accuracy.

Any package returned to the seller due to an incorrect or incomplete delivery address will be reshipped at the buyer's expense.

ARTICLE 9: COMPUTER RIGHTS AND FREEDOM

Placing orders on this site results in the collection of contractually necessary data allowing transactions to be carried out and customer orders to be processed.

The data collected (consented by the customer when creating their personal account or when creating a quote directly from the designer) is only used for purposes necessary for the service and is not shared under any circumstances. with any other service or third party in compliance with the GDPR coming into force on May 25, 2018.

The publisher undertakes to preserve the confidentiality of the information provided by the buyer, which he may be required to transmit for the use of certain services. Any information concerning him is subject to the provisions of Law No. 78-17 of January 6, 1978.

ARTICLE 10: RETURN POLICY: EXCHANGES AND REFUNDS

In application of the consumer code article L.120-20, the buyer has a period of 14 working days from receipt of his order to return it at his own expense for exchange or refund. Any return must be reported in advance by email to: anaisveronese.pro@gmail.com

This right of withdrawal is exercised without penalty, with the exception of shipping and return costs. Items must be returned in their original packaging, unwashed, unused and in perfect resalable condition. Otherwise, the products will not be returned, exchanged or refunded.

Exchanges and refunds are only applicable to so-called “in stock” items on the online store.

In view of article L 121-20-1 of the Consumer Code, only items “not specifically personalized for the customer” are refundable.

The customer will not have any right of withdrawal if these are goods made specifically and/or clearly personalized at his request, because these products cannot be the subject of subsequent marketing.

In the event of loss or damage to the returned package, the seller will not be able to reimburse the order. The customer will then have to make a claim directly with their carrier.

ARTICLE 11: APPLICABLE LAW AND JURISDICTIONS

These General Conditions are governed and interpreted in accordance with French law. In the event of a dispute or complaint, an amicable solution will be sought before any legal action. In the absence of amicable agreements, only the French courts will have jurisdiction to rule on all disputes likely to arise between the parties relating to the execution hereof.
